LEGAL NOTICE & TERMS OF SERVICE
Adivah Décor & Event Hire
1. Binding Agreement
By accepting a quotation, paying a deposit, or taking possession of hired items, the client agrees to be legally bound by these Terms & Conditions.
2. Booking & Payment Terms
- A non-refundable booking deposit is required to secure any booking.
- The full balance must be paid no later than 7 days before the event date.
- Failure to make payment may result in cancellation without refund.
- All payments must be made via approved methods (EFT unless otherwise agreed).
3. Cancellation Policy
- Cancellations made more than 14 days before the event may be partially credited at management's discretion.
- Cancellations made within 14 days of the event will result in full forfeiture of all payments.
- No refunds will be issued for cancellations due to weather, personal circumstances, or third-party failures.
4. Breakage Deposit
- A refundable breakage deposit is required and will be handled in accordance with our Breakage Deposit Policy.
- The client is liable for all loss, damage, or theft of items during the hire period.
5. Client Responsibility & Risk
The client assumes full responsibility for all hired items from delivery/collection until return and inspection.
This includes:
- Damage caused by guests, staff, or third parties
- Weather-related damage
- Theft, loss, or misuse
All hired items remain the sole property of Adivah Décor & Event Hire at all times.
6. Use of Equipment
- Items must be used strictly for their intended purpose.
- No alterations, repainting, dismantling, or misuse of items is permitted.
- Items exposed to unsafe conditions (rain, excessive heat, open flames without approval) will be considered damaged.
7. Delivery, Setup & Collection
- Delivery and collection times will be agreed in advance.
- The client must ensure safe and accessible entry to the venue.
- Delays caused by the client or venue may incur additional charges.
- Collection of items must be in the same condition and location as delivered unless otherwise arranged.
8. Inspection & Damages
- All items are checked before dispatch.
- Post-event inspection will take place within 24–72 hours.
- The client will be notified of any damages or missing items.
- Costs will be deducted from the breakage deposit or invoiced accordingly.
9. Liability Disclaimer
Adivah Décor & Event Hire shall not be held liable for:
- Injury, death, or damage arising from the use or misuse of hired items
- Any loss caused by delays, weather conditions, or circumstances beyond our control
- Failure of third-party suppliers, venues, or service providers
Use of all hired equipment is entirely at the client’s risk.
10. Force Majeure
Adivah Décor & Event Hire shall not be held liable for failure to perform due to events beyond reasonable control, including but not limited to:
- Natural disasters
- Government restrictions
- Strikes or civil unrest
- Load shedding or utility failures
11. Ownership & Recovery
All hired items remain the property of Adivah Décor & Event Hire.
Failure to return items may result in:
- Immediate invoicing for full replacement value
- Legal action and recovery costs for non-returned items
12. Legal Costs
The client agrees to be liable for any legal costs incurred by Adivah Décor & Event Hire in recovering outstanding payments or hired items on an attorney-and-client scale.
13. Indemnity Clause
The client hereby indemnifies and holds harmless Adivah Décor & Event Hire, its staff, and affiliates from any claims, damages, or losses arising from:
- The use of hired items
- The event itself
- Any third-party actions
14. Governing Law
This agreement shall be governed in accordance with the laws of the Republic of South Africa.
15. Acceptance
Acceptance of any quotation, invoice, or payment confirms that the client has read, understood, and agreed to all Terms & Conditions stated herein.
